Employment Practices Liability (EPLI)

Overview

You as an employer or co-employer need to be covered for employment practices related claims. PEOs by definition are "Professional Employers", and as such the duty to be professionals comes with the burden of also being brought into claims from your employees and from those of your client companies.

A multitude of claims occur each year ranging from hiring/firing and sexual harassment to wage and hour disputes and everything you can think of in between. These claims can produce a huge exposure, as has been evidenced by a March claim for $600,000 to an employer for an age discrimination claim.

Why do I need Employment Practices Liability Insurance? Consider the following:

Percentage of companies experiencing an EPL lawsuit in the past 5 years:

  • 44% for companies with 50 - 249 employees
  • 66% for companies with 250 - 499 employees
  • 80% for companies with 500 or more employees
  • Win or lose, the cost of defense alone now averages $125,000
  • The average jury award is $200,000 and employees win two of every three cases that make it to trial
